Terms of Service

These Terms of Service (“Terms”) govern access to and use of services provided under the Tubeyfai brand (“Tubeyfai”, “we”, “us” or “our”).

Tubeyfai is an online education and training brand operated by Nova Ananth, based in Chennai, Tamil Nadu, India.

These Terms apply to users, customers, students, members, participants and visitors using our website, learning platforms, communities, programmes, courses, memberships, webinars, bootcamps and related services.

By accessing our website, purchasing a service, enrolling in a programme, creating an account, accessing educational content or participating in a Tubeyfai programme, you acknowledge that you have read and accepted these Terms, together with any programme-specific terms and policies presented to you at the time of purchase.

Our services are intended for persons who are legally capable of entering into contracts under applicable law.

If you are below the applicable legal age or otherwise lack legal capacity, you should use our services only with the involvement and consent of an appropriate parent, guardian or legally authorised person.

Tubeyfai provides educational and training services relating to areas that may include:

• YouTube;
• content creation;
• artificial intelligence tools;
• automation;
• digital marketing;
• affiliate marketing;
• digital products;
• social media;
• online business;
• creator education;
• entrepreneurship; and
• related educational subjects.

Services may include:

• courses;
• recorded lessons;
• live sessions;
• bootcamps;
• webinars;
• mentorship;
• assignments;
• templates;
• educational resources;
• communities;
• implementation guidance; and
• other programme benefits.

The exact services included in a purchase shall be those communicated for the relevant programme or offer.

Tubeyfai provides educational information, training, guidance and mentorship.

Our services do not constitute:

• financial advice;
• investment advice;
• legal advice;
• tax advice;
• medical advice;
• accounting advice; or
• any other regulated professional advice,

unless expressly stated otherwise by a suitably qualified professional.

Participants remain responsible for independently evaluating information and obtaining professional advice where appropriate.

Payments may be processed through authorised third-party payment gateways, UPI, bank transfer, payment links or other authorised payment methods.

You agree to provide accurate information necessary to complete the transaction.

A purchase becomes binding subject to the applicable programme terms when payment is successfully processed and/or the service is otherwise accepted or delivered.

Where an instalment plan is agreed, you remain responsible for the agreed payment obligations.

Tubeyfai may use third-party payment processors and platforms.

Those providers may have their own:

• terms;
• privacy policies;
• payment procedures;
• verification requirements; and
• dispute mechanisms.

Tubeyfai is not responsible for technical failures or policies of third-party providers beyond matters within our reasonable control.

Access may be provided through:

• Tubeyfai websites;
• learning management systems;
• authorised third-party platforms;
• email;
• WhatsApp communities;
• other communication channels; or
• other technology used by Tubeyfai.

You are responsible for maintaining the confidentiality of your login credentials.

You must not:

• share your login credentials;
• resell access;
• transfer membership;
• distribute course materials;
• upload course materials publicly;
• reproduce paid content for commercial purposes;
• permit unauthorised persons to access your account; or
• circumvent access controls.

Tubeyfai programmes may provide content or benefits progressively.

Certain modules, resources, sessions, mentorship opportunities or community benefits may become available according to:

• programme schedules;
• onboarding requirements;
• payment completion;
• participation requirements;
• implementation stages;
• technical availability; or
• other programme-specific conditions.

Tubeyfai may reasonably modify the order or method of delivery while maintaining the educational substance and overall purpose of the programme, subject to applicable law.

Educational content may be:

• updated;
• expanded;
• reorganised;
• replaced;
• supplemented;
• corrected; or
• modified

from time to time to reflect changes in technology, platforms, tools, strategies or educational requirements.

No particular future lesson, tool, platform feature or third-party service is guaranteed unless expressly promised in writing as part of the specific programme.

Certain programmes may provide access to private communities or interactive groups.

Community participation is subject to reasonable rules designed to protect:

• privacy;
• safety;
• intellectual property;
• member experience;
• programme integrity; and
• orderly administration.

Tubeyfai may moderate or restrict participation where reasonably necessary because of:

• misconduct;
• harassment;
• unauthorised distribution of content;
• repeated disruption;
• abuse of community privileges;
• fraudulent activity;
• payment disputes;
• chargebacks;
• privacy concerns; or
• other legitimate administrative reasons.

Such moderation does not automatically constitute cancellation of the participant's underlying educational service.

Unless expressly stated otherwise, all Tubeyfai content is owned by or licensed to Tubeyfai and/or its content providers.

This includes:

• videos;
• recordings;
• course materials;
• PDFs;
• presentations;
• templates;
• graphics;
• text;
• audio;
• software-related materials;
• frameworks;
• methodologies;
• worksheets;
• branding; and
• other educational resources.

Your purchase provides a limited, personal, non-exclusive, non-transferable right to access and use the purchased educational materials for personal educational purposes.

It does not transfer ownership of the intellectual property to you.

You must not:

1. copy or reproduce paid course materials for unauthorised distribution;
2. sell or sublicense course access;
3. share account credentials;
4. upload paid content to public websites or groups;
5. commercially redistribute Tubeyfai materials without written permission;
6. impersonate Tubeyfai or its representatives;
7. interfere with the operation of our platforms;
8. attempt to obtain unauthorised access;
9. use our services for unlawful activities; or
10. engage in abusive, threatening or fraudulent conduct.

Tubeyfai may take reasonable action where such conduct occurs, subject to applicable law.

Where a programme includes live sessions, workshops, bootcamps or mentorship, participants are responsible for attending sessions at the communicated time or using recordings where available.

Failure to attend a session does not automatically create a refund entitlement.

Where assignments or implementation activities are part of a programme, participants remain responsible for completing them.

Refunds and cancellations are governed by the Tubeyfai Refund & Cancellation Policy and any specific terms presented at the time of purchase.

Because many Tubeyfai services involve immediate access to digital educational content and programme benefits, purchases are generally non-refundable once service delivery has commenced, subject to applicable law and any expressly stated exceptions.

Where a participant has agreed to an instalment plan and fails to make a scheduled payment, Tubeyfai may, subject to applicable law:

• request payment;
• provide a revised payment deadline;
• restrict access to future programme components;
• suspend certain benefits;
• restrict certain interactive features; or
• take other reasonable contractual steps.

Any voluntary extension or payment accommodation granted by Tubeyfai does not automatically waive the underlying payment obligation.

You are responsible for maintaining the security of:

• passwords;
• login credentials;
• OTPs;
• account access;
• email accounts; and
• other authentication information.

You must promptly inform Tubeyfai if you reasonably believe your account has been compromised.

Tubeyfai may use or recommend third-party services including platforms, software, AI tools, payment processors, hosting services, communication platforms and other technology providers.

Third-party services may have independent:

• terms;
• pricing;
• availability;
• policies;
• technical requirements; and
• privacy practices.

Tubeyfai does not guarantee the continued availability, pricing, functionality or policies of third-party services.

To the maximum extent permitted by applicable law, Tubeyfai provides educational services on an “as available” basis.

We do not warrant that:

• every service will always be uninterrupted;
• every third-party platform will remain available;
• every technical feature will remain unchanged;
• every educational strategy will produce a particular outcome; or
• every programme component will be suitable for every participant.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, Tubeyfai shall not be liable for indirect, incidental, consequential or speculative losses arising from:

• inability to achieve a desired business result;
• loss of expected income;
• platform changes;
• third-party service interruptions;
• market conditions;
• participant decisions;
• failure to implement educational recommendations; or
• circumstances beyond reasonable control.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

Tubeyfai shall not be responsible for delay or failure caused by circumstances beyond reasonable control, including:

• natural disasters;
• serious illness;
• government restrictions;
• internet or infrastructure failures;
• cyber incidents;
• third-party platform outages;
• power failures;
• strikes;
• war;
• civil disturbance; or
• other events beyond reasonable control.

Where reasonably possible, Tubeyfai may provide alternative arrangements.

Where a purchase page, registration form, checkout page or other electronic interface requires you to confirm acceptance of these Terms, your electronic confirmation, checkbox selection, payment and/or continued access may constitute evidence of acceptance to the extent recognised under applicable law.

For each purchase, the terms actually presented to and accepted by the purchaser shall be relevant to determining the contractual terms applicable to that transaction.

Tubeyfai may maintain reasonable records relating to transactions and programme delivery, including:

• payment records;
• invoices/receipts;
• access logs;
• course access records;
• onboarding records;
• attendance records;
• communications;
• assignment submissions;
• community participation;
• support requests; and
• other relevant administrative records.

Such records may be used for administration, customer support, dispute resolution, legal compliance and protection of legitimate business interests, subject to applicable law.

Personal information is handled in accordance with the Tubeyfai Privacy Policy and applicable data-protection laws.

Tubeyfai encourages parties to attempt good-faith written resolution of genuine disputes.

Where a specific programme agreement contains a mediation or arbitration provision, that provision may apply, subject to applicable law.

Nothing in these Terms is intended to unlawfully prevent a consumer from exercising any mandatory statutory right or remedy.

These Terms shall be governed by the laws of India.

Subject to applicable mandatory law and statutory consumer rights, courts having competent jurisdiction in Chennai, Tamil Nadu may have jurisdiction over disputes arising from these Terms.

Nothing in this clause is intended to exclude a jurisdiction or statutory forum where applicable law gives a consumer a mandatory right to approach such forum.

Tubeyfai may revise these Terms from time to time to reflect:

• changes in services;
• programme structures;
• technology;
• operational practices;
• security requirements;
• legal requirements; or
• other legitimate business requirements.

Revised Terms will be published with an applicable Effective Date and/or Last Updated date.

Unless otherwise required by law, revised provisions shall apply prospectively to purchases, enrolments and activities occurring after the applicable effective date.

A revised version is not intended to retrospectively alter the contractual terms applicable to a completed purchase or enrolment.

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permissible.

The remaining provisions shall continue to apply to the extent permitted by law.

Failure by Tubeyfai to enforce any provision of these Terms on one occasion does not constitute a waiver of the right to enforce that provision on another occasion.

These Terms, together with the applicable programme-specific terms, purchase terms, Refund & Cancellation Policy, Privacy Policy and any written terms expressly incorporated into the relevant purchase, constitute the agreement governing the applicable service, subject to applicable law.

Where there is a conflict between a specific written programme offer and general website terms, the specific terms presented and accepted for that purchase shall govern to the extent of the conflict, subject to applicable law.
